Covid-19 Update to Terms & Conditions

Please expect shipping delays on all orders due to the increase demand.  We are also working closely with all manufacturers to keep products available at competitive pricing.  Unfortunately, we have been informed that all manufacturers are now shipping product at an increased cost, due to demand.  Due to the recent increase in order volume, shipping on some items may be delayed up to 15 days or longer.  Items shipped from our own warehouse can be shipped sooner than items shipped direct to you from one of our fulfillment suppliers.  Additionally, our supplier network has currently prohibited the canceling or updating of all orders after they have been placed.  We appreciate your patience during this time. 

**Effective Immediately 03/09/2018**  Changes to Age Requirments Florida Orders

Due to FL SB 7026, ALL customers purchasing ANY firearm(s) and/or firearms accessories( All firearms, All ammo, All magazines, ect) must be at least twenty-one (21) years of age in Florida.  This includes all handguns and long guns. A three (3) business day waiting period will be done on ALL firearms also for local pickups, unless you fall under an exception as per FL SB 7026.  We truly apologize for this.  Please contact your local lawmakers in Florida to voice your opinion.  Do not hesitate to contact us with any questions that you may have, and we will do our best to answer them.

-Responsibility of the User

By purchasing through this website, Polk City Munitions, you agree to follow all manufacturer safety instructions for all items, firearms included, and to only use all items listed for purchase on this website in a safe manor, in an approved area, and for a legal purpose.  By visiting and/or using this website, you agree to all terms and/or responsibilities listed below.

You assume all responsibility for the legality of any item when you purchase it.  You are responsible for checking all local/state laws in the area that you reside in before ordering and/or using any items purchased from Polk City Munitions, or any manufacturers product sold here.  You are responsible for complying with all local firearms laws and/or regulations in your area.

You are responsible for full payment for all orders placed through this website.  If you are not sure that you want an item, DO NOT ORDER IT.  You must be of legal age to own any items that you order.  It is your responsibility to know local laws/regulations in your area.

You must be 18 years of age to purchase ANY item from Polk City Munitions.  Federal law requires that you are at least 18 years of age for long gun purchases, and 21 years of age of handgun purchases.  Polk City Munitions may request a copy of your state issued ID before shipping your order.

You must provide a valid contact number with all orders placed.  Polk City Munitions may contact you at the provided phone number before processing any order.  You must contact us if you have any questions or concerns.  It is your responsibility to contact us prior to placing an order if you have questions or concerns.  Please email us at Sales@PolkCityMunitions.com and include your name, contact number and order number if needed.

- With Making Any Purchase from Polk City Munitions, You Declare and Warrant That:

You are not prohibited by federal or state law, and/or local ordinance from receiving firearms, ammunition, and/or ammunition/firearm components of ANY kind.

You are at least eighteen (18) years of age if purchasing long guns, or long gun ammunition or ammunition components.  You are at least twenty-one (21) years of age if purchasing any handgun, or any ATF defined “Other” firearm.  Included, but not limited to, stripped receivers, frames, and pistol grip shotguns, ammunition or ammunition components for use in handguns.

You are the actual transferee/buyer of the firearm(s) you are purchasing from Polk City Munitions.  Notice: You are NOT the actual buyer if you are acquiring the firearm(s) on behalf of another person.

You are not under indictment in any court for a felony, or any other crime, for which the Judge could imprison you for more than one (1) year.  You have not been convicted in any court of a felony, or any other crime for which the Judge could have imprisoned you for more than one (1) year, even if you received a shorter sentence, including probation.

You are not a fugitive from Justice.  You have not been discharged from the Armed Forces under dishonorable conditions.  You have not been adjudicated mentally defective (which includes determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR, you have not been committed to a mental institution. 

You are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.  **Note that marijuana is still illegal per federal law.**  Therefor, persons with medical marijuana cards, or states where recreational use marijuana is legal, Persons who use marijuana can NOT purchase any firearm(s), and/or Any ATF regulated items from Polk City Munitions.

You are not subject to any court court order restraining you from stalking, threatening, or harassing your child, or an intimate partner or child of such partner.  You have not been convicted in any court of a misdemeanor crime of domestic violence.  You are not an alien illegally in the United States.

You are not currently on Federal NICS or state agency “DELAY” or “DENIED” status regarding your most recent attempt to purchase a firearm.  **Note that firearm(s) and/or ammunition or ammunition component sales or transfer are prohibited during these conditions**

You understand that handling, cleaning, or discharging firearms, ammunition and ammunition components may cause exposure to lead, and YOU hold Polk City Munitions harmless and You assume all responsibility for any lead exposure.

Compliance Statement

By ordering any item(s) from Polk City Munitions, you certify that you, or third party entities at your direction, will not sell, transport, ship or transfer outside the borders of the United States nor to any foreign person, any item(s) which are exported/restricted by U.S. export control law and regulation, without proper US Government export authorization, licensing, and documentation.  **Foreign Person- ITAR 120.16**  It is your responsibility to know which items fall under ITAR/EAR regulations.

You must inform Polk City Munitions, Via certified USPS mail, if any items ordered are intended to be exported by you, the buyer.  Any indication of desire to export item(s) from you, the buyer, in no way compels Polk City Munitions to assist with export in any way, before or after the purchase of item(s).  Polk City Munitions will NOT participate in any transaction, directly or indirectly, involving the illegal export or re-export of ANY Prohibited items.  By using this website and/or purchasing anything from Polk City Munitions, you, the buyer, agree to this compliance statement, and it is your responsibility to know which item(s) are regulated under ITAR/EAR regulations.

Conditions of Use

Welcome to our website.  Polk City Munitions and its affiliates provide services to you subject to the following conditions listed.  By visiting, and/or purchasing anything from Polk City Munitions, you, the buyer, agree to and accept these conditions and terms.

Fees

Polk City Munitions really appreciates your business, however in the event that orders are changed or canceled, the following fees will be assigned and/or charged.  By using this website, and/or purchasing anything from Polk City Munitions, you agree to all fees.

A Twenty percent (20%) cancellation/change fee will be charged if you cancel an order or substitute and/or change products on an order.  If you are not sure that you want items on your order, DO NOT order them!  No fee will be charged to an order for adding items to an existing order that has NOT shipped.  Once the order is shipped, it is considered complete in our system.  Any order that is canceled by you, the buyer, after the order has shipped, will be subject to full Thirty-five percent (35%) return/restocking fee.

Item Availability/QTY in Stock

Polk City Munitions will not hold or set aside any products listed.  Orders are first come, first serve.  Only once your order is fully paid for, will the order be processed and shipped.  Polk City Munitions is not responsible for errors of item QTYs in stock.  In the event that an order is placed, and that item and/or items are out of stock, a full refund will be given, and NO cancellation/change fee will be assigned.

Item Description Errors and Online Price Listed

Polk City Munitions does not guarantee that titles, descriptions and/or photos on the site are error free.  Polk City Munitions reserves the right to refuse any order including but not limited to items with errors in the listed price and/or listed descriptions.  In the event that Polk City Munitions cancels an order, we will not charge your credit card, or we will return payment in full if credit card has already been charged.  No ten percent (10%) fee will be assigned if Polk City Munitions cancels your order.

Product Descriptions

Polk City Munitions and/or its affiliates do not warrant that product and descriptions and/or other content of this site is accurate and/or free of errors.  If any product offered by Polk City Munitions is not as described, your only remedy is to return the product/item in an unused condition, with all original packing and/or papers.

Limitation of Liability and Warranty Disclaimer

This website is provided as an AS IS and on an AS Available basis.  Polk City Munitions makes no warranty of any kind, Implied or Expressed, as to the operation of this site, or any information and content on this site, or that this site and/or any emails by, and/or site servers are free of viruses, spam, and malware. Polk City Munitions is not liable for any damage caused by using this site.  By using this site, you (the user) expressly agree to these terms and understand that the use of this site is at your own risk.

License and Site Access and Use/Copy Right

Polk City Munitions grants you a limited license to this site, and to make personal use of this site, and not to download any portion of it, except with written consent from Polk City Munitions.  All content on this website is considered property of Polk City Munitions and its affiliates and is protected by United States copyright laws.

Your Account Responsibility

By using this website, you agree that you are responsible for maintaining the privacy of your account user name and/or password, for restricting any and all access to your computer, and you agree to accept all responsibility of all activities that occur with your account and/or password.  You must be eight-teen (18) years of age to use this website, and by visiting/using this website, you agree that you are at least eight-teen (18) years of age.  Polk City Munitions reserves the right to cancel any user account and to cancel any order at any time.

By using this website, you consent to receive communications from Polk City Munitions electronically.  Also, by using this website and/or by sending us emails, you understand that you are communicating with us electronically.  By using this website, you agree that all agreements, disclosure, notices and any other communications that we provide to you electronically, satisfied any and all legal requirements that such communications be in writing.

 Applicable Law

You agree, by using and/or visiting this website, that the laws of Florida will govern these terms/conditions of use and/or any sort of dispute between you (the user) and Polk City Munitions and/or any of its affiliates on this site.

Force Majeure

In the event of Force Majeure, such as earthquake, typhoon, flood, fire, and war or any other unforeseen and uncontrollable event, Polk City Munitions and/or all its affiliates will be free from all liability, if any, within the terms and conditions listed on this website.  By using this website, you agree to this.

Shipping Contract/ Risk of Lost

Any and all items purchased from Polk City Munitions are made pursuant to a shipping contract.  This means that once we deliver items purchased to the mail carrier, the risk of loss and title for the items purchased pass to you.

Shipping Terms/Rates/Ordering Processing/ Shipping of Firearm(s)

Orders will not be processed for shipping until full payment had been received and cleared.  Please allow 3-5 business days for orders to process.  Shipping terms are at the discretion of Polk City Munitions.  We use USPS, FedEx, and UPS for shipping.  Polk City Munitions follows ALL local/federal laws pertaining to shipping firearms.  Any Shipping cost will be calculated in your shopping cart during the check out process.  Any firearm(s) and/or ATF regulated item(s) will only be shipped to another Federal Firearms License holder (FFL) and a Form 4473 Firearm Transaction Record (Background Check) will be completed.

Returns/Defective Products/ Firearms

**No Returns on USED Firearms.  All Used Firearms are Sold As Is, no refunds or exchanges on USED Firearms**  New Firearms must be inspected thoroughly by the purchaser before the transfer is complete by the receiving FFL.  New Firearms can be returned within ten (10) days after the end user transfer is complete only if then firearm had NEVER been fired.  **After 1 bullet had been fired through the firearm, it is considered an used firearm**  In the event of a return/refund on a NEW firearm, full refund will be given, minus twenty percent (20%) restocking fee.  All defective firearms must be returned to the manufacturer for service and/or repairs.  Polk City Munitions is not responsible for any cost asserted with this.  All other items, non firearm related, can be returned fifteen (15) days after delivery was made, so as long as the item(s) are still in NEW condition, and the original package is still intact.  Please contact us if you are not happy with your items purchased, and we will try our best to remedy any situation.  **All Ammo sales are finial.  No Refund or exchanges on Ammop.  By using this website, you agree to these terms listed.

State Restrictions & Laws

**Effective 03/27/2018**  Changes to State Restrictions Policies

One of our core beliefs at Polk City Munitions is your RIGHT to bear arms and to protect you and yours alike.  Due to current political affairs, we feel that it is our duty to change our policies on state restrictions.  At this time, we WILL ship orders into California & New York.  Please note that all California orders will be subject to sales tax of 8.25% and all ammunition orders into California MUST ship to a FFL.  Polk City Munitions will  follow all state laws for California and New York and we reserve the right to cancel any order that we deem necessary.  We are currently working on our policies to add more states that we currently have restricted.  Being that Polk City Munitions is a FFL holder, we must make sure that we follow ALL federal and/or state laws.

Polk City Munitions is a firm believer in the right to keep and bear arms.  With that being said, certain states have restrictions and/or laws, that in our opinion, infringe on the right to keep and bear arms.  Due to laws and/or restrictions in the states listed below, Polk City Munitions will NOT process and/or ship ANY firearms, firearms parts, accessories, magazines, etc to these states.  Any order that is placed and/or processed with shipping to below listed states will be canceled by Polk City Munitions and given full refund of the processed amount. We really do apologize for this.  If you reside in one of these states, please petition your local and/or state government to change and/or undo current laws, that in our opinion, infringe on your rights to keep and bear arms.

**Polk City Munitions will NOT ship to the following States/US Territories at this time-  Alaska, California, Colorado, Connecticut, Hawaii, Illinois, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New York, Puerto Rico, Washington D.C.**

Other Site Policies

Please take the time to review other policies listed on this site. Polk City Munitions reserves the right to make any changes to our site, Conditions of Use, Terms and Conditions, and policies at any time.  If any thing listed in these terms and/or policies is deemed invalid and/or unenforceable under the laws of Florida and/or the state that you reside in, that term and/or condition shall be deemed severable and shall not affect the validity of any other remaining terms and/or conditions.

Straw Purchase (Firearms)

A Straw Purchase, by definition, is a criminal act in which a person who is prohibited from buying firearms uses another person to buy a firearm(s) on their behalf.  The person making the straw purchase can be charged with making false statements on a Federal Firearms Transaction Record. (Form 4473)  If you are NOT the actual end user of the firearm(s) purchased, then you can be charged under local/federal laws for making false statements on a Federal Firearms Transaction Record. (Form 4473)  DO NOT LIE FOR THE OTHER PERSON(S)!!  By purchasing ANY firearm(s) from Polk City Munitions, you agree that you are the end user of the firearm(s) purchased.  Polk City Munitions will fully cooperate with local/federal law enforcement in the event of any investigation into any suspected Straw Purchase. **If a firearm(s) is purchased as an intended gift, the transaction is NOT considered a Straw Purchase, and the person purchasing the intended gift is considered the end user of the firearm(s), so as long as the person(s) intended to receive the gift is not prohibited from owning and/or be around a firearm(s).**

Sales Tax

All Florida orders will be charged sales tax of 7%.

All California orders will be charged sales tax of 8.25%.

Giveaway Terms & Conditions

Must be at least eighteen (18) years of age to enter any giveaway and at least twenty one (21) years of age to enter any firearm giveaway.  By entering any give away from Polk City Munitions, you agree to all of Polk City Munitions Policies, and/or Terms & Conditions located here.  Must be a US citizen to enter any and all giveaways.  Please note that some US states and US Territories have laws and/or restrictions that pertain to the sell and/or use of some firearms, firearms parts and accessories, magazines and ammo.  It is your responsibility to know the laws and/or regulations in your home state and/or local county.  In the event that a winner is selected for a giveaway, and they can not legally own the item, Polk City Munitions will then select another winner.  Any and all items offered in any giveaway from Polk City Munitions will only be shipped to the name of the winner and the address provided.  We will not change any shipping and/or address information once a winner is selected.  Polk City Munitions will cover all shipping cost.  In the event of a firearm giveaway, all Federal and Local laws will apply to the winner.  Polk City Munitions will only ship firearms to another FFL holder to complete the transfer/ background check (ATF Form 4473) on then winner that is selected.  Polk City Munitions will cover the shipping cost on all firearms that are offered in a giveaway, but we will NOT cover the cost associated with the transfer/ background check (ATF Form 4473) that must be completed on the winner that is selected.  The winning person must cover the cost of any and all background checks and/or transfer fees for firearms in their area.  In the event that a winner is selected for a firearm and they are located around Polk City Munitions geographical location, Polk City Munitions will complete the transfer/ background check (ATF Form 4473) on the winner.  A fee of $10 will apply, the winner will have to cover this cost.  Polk City Munitions is the sole provider of any and all giveaways offered through our web site and/or our Facebook page.  Any affiliates of Polk City Munitions are no way responsible for any item(s) and/or cost related.  Polk City Munitions reserves the right to cancel any giveaway with out notice and to select another winner in any giveaway.  By entering any giveaway with Polk City Munitions, you agree to all terms and conditions.
